1. Acceptance of terms
These Terms & Conditions ("Terms") form a legally binding agreement between you and Brainrecally ("BrainRecally", "we", "us", "our") governing your access to and use of the website at brainrecally.com and all content, features and services made available through it (collectively, the "Service").
By accessing, browsing or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must stop using the Service immediately.
2. What BrainRecally provides
BrainRecally is a free, advertising-supported educational website that publishes flashcard decks across academic and professional subjects, together with an interactive study mode for reviewing them.
The Service is provided on the following basis:
- Access is free of charge. We do not currently charge for any content or feature.
- No account is required to view or study any deck.
- Content is supplied for study and revision support only.
- We may add, modify, restrict or remove any part of the Service at any time.
BrainRecally is not a school, university, awarding body or accredited training provider. We do not issue qualifications, certificates or credits.
3. Eligibility and age
The Service is intended for a general audience and is not directed at children under 13. If you are under 13, you may only use the Service with the involvement and consent of a parent or legal guardian.
If you are between 13 and the age of majority in your jurisdiction, you confirm that your parent or guardian has reviewed and agreed to these Terms on your behalf. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
4. Acceptable use
You agree to use the Service lawfully and responsibly. You must not:
- Use automated tools — including scrapers, crawlers, bots or scripts — to systematically extract, copy or harvest content, except for well-behaved search engine crawlers that respect our
robots.txt. - Reproduce, redistribute, republish, sell, licence, sublicence or otherwise commercially exploit any substantial part of our content without prior written permission.
- Attempt to gain unauthorised access to any part of the Service, its servers, databases, admin areas or related infrastructure.
- Interfere with or disrupt the Service, including by transmitting malware, launching denial-of-service attacks, or placing unreasonable load on our infrastructure.
- Circumvent, disable or interfere with security features, rate limits or access controls.
- Remove, obscure or alter any copyright, trademark or other proprietary notice.
- Use the Service to infringe the rights of others, or for any unlawful, fraudulent, defamatory, harassing or otherwise harmful purpose.
- Present our content as your own, or misrepresent your relationship with BrainRecally.
- Use the Service in a manner that breaches the rules or code of conduct of any examination body, school or institution — including during any assessment where external materials are prohibited.
We reserve the right to investigate suspected breaches and to restrict or block access — including by IP address — where we reasonably believe a breach has occurred.
5. Accounts and admin access
Public use of the Service requires no account. Certain administrative areas are restricted to authorised personnel. If you have been granted administrative credentials, you agree to:
- Keep those credentials confidential and not share them with any third party.
- Use a strong, unique password and enable any available additional security measures.
- Notify us immediately at support@brainrecally.com if you suspect unauthorised access.
- Accept responsibility for all activity carried out under your credentials.
We may suspend or revoke administrative access at any time, at our sole discretion.
6. Intellectual property
Our rights
Unless otherwise stated, all content on the Service — including flashcard questions and answers, deck and category descriptions, editorial copy, page design, layout, graphics, logos, and the arrangement and selection of content — is owned by BrainRecally or licensed to us, and is protected by copyright, database rights, trademark and other intellectual property laws.
What you may do
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service, and to view, temporarily download and print content for your own personal, non-commercial study. You may also share links to our pages freely.
What you may not do
All other uses require our prior written consent. In particular, you may not bulk-copy decks into another platform or app, incorporate our content into paid products or services, or create derivative datasets from our content — whether for training machine learning models or otherwise.
Third-party marks
Names of examinations, qualifications, awarding bodies, certifications and institutions referenced on the Service (for example GCSE, A-Level, AP, SAT, GRE, IELTS, TOEFL, NCLEX, CompTIA) are the trademarks of their respective owners. Their use here is purely descriptive, to indicate the subject matter our decks cover. BrainRecally is not affiliated with, endorsed by, sponsored by, or accredited by any of these organisations.
Copyright complaints
If you believe content on the Service infringes your copyright, contact us at support@brainrecally.com with (a) identification of the work, (b) the URL of the material in question, (c) your contact details, and (d) a statement of your good-faith belief that the use is unauthorised. We investigate all such notices promptly and will remove infringing material where appropriate.
7. Content you send us
If you submit feedback, corrections, deck requests, suggestions or any other material to us (for example via the contact form or by email) ("Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, publish and incorporate those Submissions into the Service without restriction, attribution or compensation.
You confirm that any Submission:
- Is yours to give, or that you have all necessary rights and permissions.
- Does not infringe the intellectual property, privacy or other rights of any third party.
- Is not unlawful, defamatory, misleading, obscene or otherwise objectionable.
- Contains no confidential information you do not wish to be made public.
We are under no obligation to act on, respond to, or publish any Submission.
8. Advertising and third parties
The Service is funded by third-party advertising, including Google AdSense. Advertisements and sponsored content are supplied by external networks and advertisers over whom we have limited control.
- We do not endorse, verify or accept responsibility for advertised products, services or claims.
- Any dealings with an advertiser are solely between you and that advertiser.
- Advertising partners may use cookies and similar technologies — see our Privacy Policy.
- The Service may contain links to external websites. We are not responsible for their content, accuracy, security or privacy practices, and linking does not imply endorsement.
You follow external links entirely at your own risk.
9. Accuracy and academic disclaimer
We invest genuine effort in producing accurate, curriculum-relevant flashcards, and we correct reported errors as quickly as we reasonably can. Nevertheless:
- We give no warranty or guarantee that any content is accurate, complete, current or free from error.
- Syllabi, guidelines, standards and best practice change; content may become outdated without notice.
- Content is a study aid only and is not a substitute for your official syllabus, textbooks, lectures or teacher guidance.
- We make no promise regarding examination results or academic or professional outcomes.
Medical, nursing, pharmacology and health-related content is provided strictly for educational purposes only. It does not constitute medical advice, diagnosis, treatment guidance or clinical protocol, and must never be relied upon for patient care or any clinical decision. Always defer to your institution's protocols, current clinical guidelines and a qualified supervising professional.
Similarly, nothing on the Service constitutes legal, financial, engineering, or other professional advice. Always verify against authoritative primary sources before acting.
10. Availability and changes
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, secure or error-free operation. Access may be suspended, withdrawn or restricted at any time without notice for maintenance, upgrades, security, legal or commercial reasons.
We may modify, suspend or discontinue any feature, deck, category or the entire Service at our discretion. We are not liable to you for any such change or discontinuation.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
11. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to that, to the fullest extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage.
- We shall not be liable for loss of profits, revenue, business, goodwill, opportunity, anticipated savings, or loss or corruption of data.
- We shall not be liable for any examination failure, academic penalty, professional consequence, disciplinary action or other adverse outcome arising from use of or reliance on the Service.
- We shall not be liable for any loss arising from third-party advertising, external links, or content supplied by third parties.
- Our total aggregate liability arising out of or in connection with the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed GBP 100 (one hundred pounds sterling).
You acknowledge that the Service is provided free of charge and that these limitations are a reasonable allocation of risk in that context.
12. Indemnity
You agree to indemnify, defend and hold harmless BrainRecally, its operators, contributors and agents from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Service, or your infringement of any third-party right.
13. Termination
We may terminate or suspend your access to the Service immediately and without notice if we reasonably believe you have breached these Terms or that your use presents a legal, security or operational risk.
You may stop using the Service at any time. Sections concerning intellectual property, Submissions, disclaimers, limitation of liability, indemnity and governing law survive termination.
14. Governing law and jurisdiction
These Terms, their subject matter and their formation are governed by the laws of England and Wales, without regard to conflict of law principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.
If you access the Service from outside the United Kingdom, you are responsible for compliance with your own local laws. Nothing in this clause removes any mandatory consumer protection rights available to you under the law of your country of residence.
15. Changes to these terms
We may revise these Terms from time to time to reflect changes in law, our practices, or the Service itself. The current version always appears on this page with the effective date shown at the top.
Material changes will be signalled by updating that date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

Miscellaneous
Severability: if any provision is held invalid or unenforceable, the remaining provisions continue in full force. No waiver: our failure to enforce any right does not waive it. Entire agreement: these Terms together with the Privacy Policy constitute the entire agreement between us regarding the Service. Assignment: you may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition or sale of assets.
